These Terms and Conditions ("Terms") govern the use of services provided by MoaIT ("we", "us", "our"), a mobile application development company. By engaging our services, you ("Client", "you") agree to be bound by these Terms in full.
MoaIT designs and develops native iOS and Android mobile applications for businesses. Our services include but are not limited to:
All project quotations are provided in writing and are valid for 14 days from the date of issue. Prices are fixed once a proposal is accepted and a contract is signed. We do not charge hidden fees. Any additional features or changes requested after the contract is signed may incur additional costs, which will be communicated and agreed upon before work begins.
A deposit of 50% of the total project cost is required before work begins. The remaining 50% is due upon delivery of the completed application. Payments can be made via bank transfer or other agreed-upon methods. Late payments may result in project delays or suspension until the outstanding balance is settled.
Estimated delivery timelines are provided in the project proposal. Most standard projects are completed within 30 days of contract signing. Complex projects may require additional time, which will be agreed upon upfront. Delays caused by the Client (such as delayed feedback, content, or approvals) may extend the timeline. We will communicate any changes to the schedule promptly.
Each project includes two rounds of design revisions as standard. Additional revision rounds may be arranged at an additional cost. Revisions apply to the design phase only — once development begins, design changes may require a change request and additional fees.
Upon full payment, the Client receives full ownership of the completed application, including all design assets and deliverables created specifically for their project. However, the underlying source code remains the exclusive property of MoaIT. The Client is granted a perpetual, non-exclusive licence to use the application as delivered, but may not resell, redistribute, or sublicence the source code. MoaIT retains the right to reuse code, libraries, frameworks, and development tools across projects. We also reserve the right to showcase the completed project in our portfolio unless the Client requests otherwise in writing.
We take confidentiality seriously. A Non-Disclosure Agreement (NDA) is signed before any project details are discussed. Both parties agree not to disclose confidential information shared during the project without prior written consent. This obligation survives the termination of the project.
Post-launch hosting and maintenance are offered as a separate monthly service. This includes server hosting, security updates, bug fixes, and minor adjustments. The monthly fee is determined based on the app's complexity and requirements. Either party may terminate the hosting and maintenance agreement with 30 days' written notice.
We handle the submission of your app to both the Apple App Store and Google Play Store. However, approval is ultimately at the discretion of Apple and Google. We will make reasonable efforts to ensure your app meets their guidelines, but we cannot guarantee approval timelines or outcomes. Any fees charged by Apple or Google (such as developer account fees) are covered by MoaIT at no additional cost to the Client.

MoaIT shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or the application we develop. Our total liability shall not exceed the total amount paid by the Client for the project in question. We are not responsible for any losses arising from third-party services, App Store or Play Store policies, or factors beyond our reasonable control.
Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation between both parties. If a resolution cannot be reached, the dispute shall be settled through mediation or, if necessary, through the courts of the jurisdiction in which MoaIT is registered.
We reserve the right to update these Terms at any time. Clients will be notified of any changes by email at least one month before the updated Terms take effect. Changes will also be posted on this page with an updated "Last updated" date. Continued use of our services after the updated Terms take effect constitutes acceptance of the revised Terms.
